General information
We are Joii UK Limited (“Joii”, “we”, “us”), a company registered in England and Wales under company number 13513353. Our registered office is 8 Beauvale, Ferdinand Street, London, NW1 8EY.
Please read these Terms and Conditions (“Our Terms”) carefully before using our software application (the “Joii app”), our website https://joiicare.com or our services.
In addition to Our Terms, our Privacy Policy is available on the Joii app and at https://joiicare.com/privacy. The Privacy Policy describes what personal data we collect, how we handle it, why we need it and who we share it with.
Our Terms govern your use of the Joii app and services, through which you can evaluate your cycle, receive insights about your menstrual health, and/or contribute to research. The Joii app is intended to be used on your iOS or Android mobile device. We are continually developing new features and products and will keep you updated on developments.
Our Terms constitute a legally binding agreement between you and Joii concerning your access to and use of the Joii app. By accessing the app you confirm that you have read, understood and agree to be bound by Our Terms. If you do not agree, please do not use the app or website.
Age and consent
The Joii app is intended for users who are at least 13 years of age. However, if you reside in the European Union, the UK, or Canada, you must be at least 16 years old to use the app due to local privacy laws. Users who are minors in the jurisdiction in which they reside must have the permission of a parent or guardian, who should read and agree to Our Terms before the minor uses the app.
Our services
We provide a patented evaluation software application that, working alongside our evaluation pad, analyses the volume of menstrual fluid lost and provides a quantitative analysis. The app can evaluate menstrual fluid across a cycle and identify the presence of clots, and allows users to track their cycle and log symptoms they may be experiencing.
You can gather information about your own menstrual health and may also choose to participate in menstrual data collection to contribute to menstrual health research. Participation is voluntary.
Where data is used in our own marketing or public-awareness materials, it is presented only in aggregate form (for example, average fluid levels by age group), as described in the Privacy Policy.
Pricing, orders and the evaluation pad
The Joii app can be downloaded through the Apple App Store or Google Play. Evaluation pads can be ordered through https://joiicare.com.
Purchases of evaluation pads are governed by our separate Terms of Sale, which set out pricing, payment, delivery, and your cancellation and refund rights. Please read the Terms of Sale before placing an order; by completing a purchase you agree to them.
Medical disclaimer
The Joii app is a Class I medical device (patient general health self-management software), and Joii UK Limited is registered with the UK Medicines and Healthcare products Regulatory Agency (MHRA).
Joii is intended to support the self-management of menstrual health, helping you record and track information about your cycle, flow and related symptoms. It does not provide medical advice, diagnosis or treatment, and is not intended to diagnose, treat, cure or prevent any disease or condition.
Joii is not a substitute for professional medical care. Always consult a qualified healthcare professional for any medical concern, and do not disregard or delay seeking medical advice because of information provided by the app. Specific medical conditions can only be diagnosed and treated by a qualified healthcare professional.
Intellectual property
Unless otherwise noted, the graphics, images, buttons, layout and text contained in the Joii app and website, and in the sites of Joii and its related, affiliated and subsidiary companies, are the exclusive property of Joii UK Limited and/or its related companies, or are used with permission, and may not be copied or distributed, in whole or in part, without the express written consent of Joii UK Limited. Information in the app or website may not be copied, transmitted, amended or reproduced in any form without the prior consent of Joii UK Limited.
Software and liability
We take care to provide a safe and reliable experience, but we do not warrant that the website, the Joii app, or any material accessible through them is free from viruses or other harmful components, and you are responsible for using appropriate virus protection.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under the laws of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.
Subject to the paragraph above, and to the extent permitted by law: (a) we are not liable for any indirect or consequential loss, or for loss of profits, data or goodwill, arising from your use of, or inability to use, the website or the Joii app, or from any material on linked third-party websites; and (b) our total liability to you arising out of or in connection with these Terms or the Joii app shall not exceed £1,000 (subject to legal review).
Where any provision of these Terms would exclude or limit our liability further than is permitted under the laws of England and Wales, that provision shall apply only to the maximum extent permitted by law.
Important: the Joii app does not provide medical advice, diagnosis or treatment, and you should not rely on it as a substitute for professional medical care. Please also read our Medical Disclaimer.
User conduct
When accessing the Joii app or website, you may not:
Post or transmit any unlawful, threatening, abusive, defamatory, obscene, pornographic or otherwise objectionable content, including anything that would constitute a criminal offence, give rise to civil liability, or violate any law;
Post or transmit any information or software containing a virus, worm, trojan horse or other harmful component, or restrict or inhibit any other user from using the website;
Post, publish, transmit, reproduce, distribute or exploit any information, software or other material obtained through our web pages for commercial purposes other than as expressly permitted.
Governing law and jurisdiction
Our Terms, and your use of the Joii app and website, are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any claims or disputes arising in relation to, out of, or in connection with the Joii app, this website and their use.
Amendments to Our Terms
We may update Our Terms from time to time. Where changes are material, we will take reasonable steps to bring them to your attention. Your continued use of the Joii app or website after changes take effect constitutes acceptance of the updated Terms.
